    Industry Automobile rescue the global crisis and especially the United States has no truce and who would have thought what happened with the huge companies that are currently begging to save the disappearing from the map.

    Judge Refuses to Dismiss Pan Am Suit

    NEW YORK – The Association of Former Pan Am Employees, Inc. (”AFPAE”) announces that, in the class action entitled Pineiro v. PBGC, 96 Civ. 7392 (LAP)(S.D.N.Y.), Judge Preska (U.S.D.J.) issued on March 13, 2000 her third opinion on PBGC’s motion to dismiss the complaint in this action.

    Judge Preska rejected PBGC’s attempt to dismiss this action and greatly expanded PBGC’s fiduciary responsibilities to the former Pan Am employees. Former Pan Am employees should now have their day in court with their claims that PBGC breached its fiduciary duties and committed other wrongful actions in its role as trustee of the Pan Am retirement plan.

    At least 14,000 workers have yet to be informed of the benefits due them nearly nine years after the airline folded. David Cay Johnston, NY Times, “The ruling, which eventually may lead to an increase in pension payments for some of the 65,000 people who worked for Pan Am when it went out of business in 1991, affects the way the Pension Benefit Guaranty Corporation administers pension plans. The Association says the Guaranty Corp issued thousands of workers deter minations of the benefits due them that were improper, failing to abide by the terms of the agreement negotiated between Pan Am and its unions.”

    This decision is unprecedented in expanding the rights and claims of former Pan Am employees against the PBGC and is a substantial victory not only for former Pan Am employees but also for all similarly situated individuals. As a result of the decision, the PBGC will finally be forced to respect the rights of former employees under terminated retirement plans in the same manner as any other plan fiduciary.

    Co-Chair Kevin D. Mahar. Retired from GE after 33 years service. Former President of IUE Local 201 and elected for 21 years as a full-time representative of Local 201 members. Kevin holds the distinction of being the longest serving elected president of Local 201. He is President Emeritus of the AFL-CIO North Shore Labor Council and past Vice-President of AFL-CIO Massachusetts State Labor Council.

    Kevin is an activist who continues to work for his community, serving on many board of directors such as the YMCA.

    MISSION: 1. Persuade GE to share our huge pension fund and its $15.8 billion dollar surplus. 2. Provide a lump sum make-up for the lack of past cost-of-living increases. 3. Provide annual, automatic COLAs to assure retirees maintain their purchasing power. 4. Designate a retiree/union representative on the GE pension trust fund to assure adequate retiree representation. 5. Remain vigilant to defeat corporate sponsored legislation that would diminish or delete our pension funds or health insurance, and to advocate for legislation for the availability, protection and improvement of pensions.

    CURRENT ISSUES: Our retirees will continue demonstrations for an annual COLA which GE has not contributed to our pension fund since 1987. That year our fund value was $17.2 billion; in 1997, it was worth $38.7 billion; and as of the beginning of 1999, the GE fund had soared to $43.447 billion. THE CURRENT SURPLUS ESTIMATES ARE ALMOST $16 BILLION AND GROWING! Without any cost to its Treasury, all GE retirees’ pensions could be elevated on an ongoing basis to ensure their purchasing power.
